What is pornography?

Examples of pornography are texts, pictures, movies and other illustrations depicting sexual acts. Pornography only involves physical sexual acts. All other aspects of sexuality, such as love and affection, are ignored. Therefore, pornography is indeed never the same as real sex. Pornography serves to satisfy people's interest in sexual things.

Is pornography allowed in Germany?

In Germany, it is permitted to produce, watch, own, show, buy, sell, trade or distribute in another way legal pornographic material in the form of texts, recordings, pictures, movies and other illustrations. 

Legal pornography

1. All persons must participate willingly.
2. All persons must agree to its publication.
3. All persons must be at least 18 years old.
4. A person must be at least 18 years old in order to produce, watch, own, show, buy, sell trade or distribute in another way pornographic material. It is forbidden to show or give pornographic material to persons under the age of 18 years.

Illegal pornography: what is forbidden?

There are certain forms of pornography that are forbidden in Germany. Even the attempt to produce, watch, own, show, sell, trade or distribute in another way such pornography is punishable.

The following is forbidden:

• acts of violence, such as rape
• sexual acts by people with animals
• sexual acts with children (a person under 14, see also 'child pornography') and/or young people under 18
• pictures of a naked or partially naked child/young person in a posture that unnaturally highlights sexual features
• sexually suggestive pictures of a child's genital area (vagina, buttocks and breast for girls or buttocks and penis for boys)

پورنوگرافی چیست؟

پورنوگرافی عبارت است از مثلاً نوشته، عکس، فیلم و یا سایر نمایشهایی که کارهای جنسی را نمایش میدهد. پورنوگرافی فقط شامل کارهای بدنی سکسی است. کلیه جنبه های دیگر میل جنسی مانند عشق و علاقه، نادیده گرفته میشود. به همین دلیل هم پورنوگرافی هیچ وقت همانند سکس واقعی نیست. پورنوگرافی درخدمت ارضای علاقمندی افراد به چیزهای جنسی است.

آیا پورنوگرافی در آلمان مجاز است؟

در آلمان، تولید، تماشا، مالکیت، نمایش، خرید، فروش، معامله و یا انواع دیگر انتشار محصولات مجاز پورنوگرافی به شکل نوشته، صوتی، تصویری، فیلم و سایر اشکال نمایش، مجاز است.

پورنوگرافی مجاز

1. همه افراد باید به صورت داوطلبانه مشارکت کنند.
2. همه افراد باید با انتشار موافق باشند.
3. همه افراد باید بالای 18 سال باشند.
4. افراد باید برای تولید، تماشا، مالکیت، نمایش، خرید، فروش، معامله و یا سایر انواع انتشار، حداقل 18 سال داشته باشند. نمایش یا در اختیار گذاشتن محصولات پورنوگرافی به اشخاص زیر 18 سال ممنوع است.

پورنوگرافی غیرمجاز: چه چیزهایی ممنوع است؟

انواع خاصی از پورنوگرافی در آلمان ممنوع است. حتی تلاش در جهت تولید، تماشا، مالکیت، نمایش، خرید، فروش، معامله و یا سایر انواع انتشار، در اینگونه موارد قابل مجازات است.

موارد زیر ممنوع است:

• کارهای همراه با خشونت، مثلاً تجاوز
• کارهای جنسی انسان با حیوانات
• کارهای جنسی با کودکان، یعنی با اشخاص زیر 14 سال (مدخل پورنوگرافی کودکان را نگاه کنید) و/ یا با نوجوانان و جوانان زیر 18 سال
• تصاویر کودکان / نوجوانان برهنه یا نیمه برهنه ودر حالت تأکید غیر طبیعی بر مشخصات جنسیتی
• تصویر تحریک آمیز جنسی از اندامهای حساس و جنسی کودکان (مهبل (واژن)، باسن و سینه در مورد دختران و یا باسن و آلت جنسی در پسران)
