Çfarë është pornografia?
Tek pornografia hyjnë tekstet, fotografitë, filmat ose interpretimet e tjera, të cilat shfaqin veprime seksuale. Këtu bëhet fjalë vetëm për aktet fizike seksuale. Aspektet e tjera të seksualitetit, si përshembull dashuria dhe afeksioni, nuk përfillen. Për këtë arsye, pornografia asnjëherë nuk është njësoj si seksi i vërtetë. Pornografia shërben për të kënaqur interesin e njerëzve për gjëra seksuale.
Lejohet pornografia në Gjermani?
Në Gjermani lejohet prodhimi, shikimi, posedimi, blerja, shitja e materialit pornografik legal, tregtia ose shpërndarja e tij diku tjetër, në formën e teksteve, inçizimeve tonike, fotografive, filmave dhe interpretimeve të tjera.
Pornografia legale
- Të gjithë personat duhet të marrin pjesë me vullnet të lirë.
- Të gjithë personat duhet të jenë dakort me publikimin.
- Të gjithë personat duhet të jenë të paktën 18 vjeç.
- Për prodhimin, shikimin, posedimi, blerjen, shitjen e materialit pornografik, tregtinë ose shpërndarjen e tij diku tjetër, duhet të jesh të paktën 18 vjeç. Është e ndaluar që t´iu tregosh apo t´iu japësh personave nën moshën 18 vjeç material pornografik.
Pornografia ilegale: Çfarë është e ndaluar?
Ka disa lloje pornografie, të cilat janë të ndaluara në Gjermani. Edhe tentativa e prodhimin, shikimit, posedimi, blerjes, shitjes së pornografisë së tillë, tregtisë ose shpërndarjes së saj diku tjetër, ndëshkohet.
Të ndaluara janë:
- Veprimet e dhunshme, si psh. përdhunimet
- Veprimet seksuale të njerëzve me kafshët
- Veprimet seksuale me fëmijët, pra me personat nën moshën 14 vjeç (shih edhe pornografinë me fëmijët) dhe/ose me adoleshentët deri në moshën 18 vjeç.
- Fotografitë e një fëmije/adoleshenti të zhveshur ose pjesërisht të zhveshur, ne një pozicion trupi, i cili thekson karakteristikat seksuale në mënyrë të panatyrshme.
- Fotografitë provokante seksuale të pjesës intime të trupit (vagina, prapanica dhe gjoksi tek vajzat ose prapanica dhe penisi tek djemtë) të një fëmije.
What is pornography?
Examples of pornography are texts, pictures, movies and other illustrations depicting sexual acts. Pornography only involves physical sexual acts. All other aspects of sexuality, such as love and affection, are ignored. Therefore, pornography is indeed never the same as real sex. Pornography serves to satisfy people's interest in sexual things.
Is pornography allowed in Germany?
In Germany, it is permitted to produce, watch, own, show, buy, sell, trade or distribute in another way legal pornographic material in the form of texts, recordings, pictures, movies and other illustrations.
Legal pornography
- All persons must participate willingly.
- All persons must agree to its publication.
- All persons must be at least 18 years old.
- A person must be at least 18 years old in order to produce, watch, own, show, buy, sell trade or distribute in another way pornographic material. It is forbidden to show or give pornographic material to persons under the age of 18 years.
Illegal pornography: what is forbidden?
There are certain forms of pornography that are forbidden in Germany. Even the attempt to produce, watch, own, show, sell, trade or distribute in another way such pornography is punishable.
The following is forbidden:
- acts of violence, such as rape
- sexual acts by people with animals
- sexual acts with children (a person under 14, see also 'child pornography') and/or young people under 18
- pictures of a naked or partially naked child/young person in a posture that unnaturally highlights sexual features
- sexually suggestive pictures of a child's genital area (vagina, buttocks and breast for girls or buttocks and penis for boys)
